Terms of Service (EULA)
Effective Date: January 15, 2026
This End User License Agreement ("EULA", "Agreement", or "Terms") constitutes a legally binding agreement between you (either an individual or a single entity) and APOGEA ("the Company", "we", "us") regarding the FlowRun software (the "Software").
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.
1. License Grant
Subject to compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the Software solely for your internal business purposes.
2. Software Components and Installation Consent
You acknowledge that the Software is a composite system requiring the installation of several components on your device, including but not limited to:
- (a) A plugin component that integrates with Autodesk Revit.
- (b) Local background services (including but not limited to a Python server and a Node.js runtime) running on your device to process tasks and communicate with third-party services.
You hereby consent to the installation of these components and their necessary software dependencies.
3. Usage Restrictions
You may not, nor permit others to:
- (a) Sell, rent, lease, sublicense, or redistribute the Software.
- (b) Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Software, except to the extent permitted by applicable law.
- (c) Modify or create derivative works based on the Software, except for configuration files explicitly designated for user customization.
- (d) Remove any proprietary notices or labels from the Software.
4. Third-Party Services
The Software relies on third-party services for full functionality, including but not limited to Google Firebase (for authentication and database services) and Anthropic Claude (for AI processing). Your use of the Software is also subject to the terms and privacy policies of these providers.
YOU ACKNOWLEDGE THAT THE SOFTWARE UTILIZES THIRD-PARTY ARTIFICIAL INTELLIGENCE (AI) MODELS TO INTERPRET REQUESTS AND GENERATE OUTPUTS (INCLUDING THE MODIFICATION OF REVIT MODEL DATA).
THE COMPANY MAKES NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, SUITABILITY, OR ERROR-FREE NATURE OF ANY OUTPUT GENERATED BY AI. AI OUTPUT MAY CONTAIN ERRORS, OMISSIONS, OR INCORRECT DATA.
YOU ARE SOLELY RESPONSIBLE FOR THE INDEPENDENT REVIEW, VALIDATION, AND VERIFICATION OF ALL AI OUTPUT BEFORE RELYING ON IT OR SAVING ANY CHANGES TO YOUR PROJECTS.
THE COMPANY SHALL HAVE NO LIABILITY FOR ANY DATA LOSS, DESIGN ERRORS, PROJECT DELAYS, OR ANY OTHER DIRECT OR INDIRECT DAMAGES ARISING FROM YOUR RELIANCE ON OR USE OF THE AI-GENERATED OUTPUT.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING:
- (a) LOCAL CREDENTIAL STORAGE: To facilitate login, the Software stores your login credentials on your local device. These credentials are encrypted using your operating system's data protection mechanisms (DPAPI).
- (b) ENCRYPTED LOCAL COMMUNICATION: The internal components of the Software communicate with each other on your device via an encrypted local network channel (HTTPS).
YOU ACCEPT THESE METHODS OF OPERATION AND ASSUME ALL ASSOCIATED RISKS. YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOUR LOCAL DEVICE AND ENVIRONMENT ARE SECURE.
7. No Warranty
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE.
9. Termination
This EULA will automatically terminate if you fail to comply with any of its terms. You may also terminate it at any time by permanently uninstalling the Software.
10. Governing Law and Jurisdiction
This EULA shall be governed by and construed in accordance with the laws of Spain. You agree to submit to the exclusive jurisdiction of the courts of Madrid, Spain.
