Terms of Service (EULA)

This End User License Agreement ("EULA", "Agreement", or "Terms") constitutes a legally binding agreement between you (either an individual or a single entity) and APOGEA ("the Company", "we", "us") regarding the FlowRun software (the "Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.

Subject to compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the Software solely for your internal business purposes.

The Software relies on third-party services for full functionality, including but not limited to Google Firebase (for authentication and database services) and Anthropic Claude (for AI processing). Your use of the Software is also subject to the terms and privacy policies of these providers.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE.

9. Termination

This EULA will automatically terminate if you fail to comply with any of its terms. You may also terminate it at any time by permanently uninstalling the Software.

10. Governing Law and Jurisdiction

This EULA shall be governed by and construed in accordance with the laws of Spain. You agree to submit to the exclusive jurisdiction of the courts of Madrid, Spain.
